Terms and Conditions (AGB)

 


2. Contractual Partner & Conclusion of Contract

The purchase contract is concluded with Ina Sellke (SAART™ – Blumenfarm Kanzem).

By clicking the “Buy” button, you submit a binding order. The order confirmation is sent automatically by email. A binding contract is only concluded upon shipping confirmation or delivery of the goods.


3. Products & Special Characteristics

You purchase hand-picked seeds and/or tubers from small-scale, sustainable cultivation.

Please note:

  • These are natural products. Variations in colour, shape, size, or germination rate may occur.

  • A 100% germination guarantee cannot be given.

  • Tubers may show natural irregularities.


4. Prices & Shipping Costs

All prices stated are final prices in accordance with §19 German VAT Act (small business regulation – no VAT is shown).

Shipping costs are added and displayed at checkout:

  • Germany: €2.75 / €3.50

  • EU: €4.99

(Additional zones may be added.)


5. Payment

The following payment methods are available in the shop:

  • PayPal

  • Credit card (via Shopify Payments)

Additional payment methods may be added.
Payment is due immediately upon placing the order.


6. Delivery

Shipping is available within Germany and the European Union.

Delivery times:

  • Germany: approx. 2–5 business days

  • EU: approx. 5–10 business days

Shipping is made to the address provided by the customer.
If an item is unavailable, you will be informed immediately and any payments already made will be refunded.


7. Retention of Title

The goods remain the property of SAART™ – Blumenfarm Kanzem until full payment has been received.


8. Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal.

The full withdrawal policy can be found in the withdrawal instructions on this website.

Exceptions to the right of withdrawal include:

  • Seed packets that have already been opened or damaged

  • Live plants/tubers that have been unpacked or planted

  • Custom-made or personalised products


9. Complaints & Liability

Despite careful selection, no complete guarantee can be given for natural products.

Liability claims only exist for damages caused by intentional or grossly negligent breaches of duty.
Liability for growth success or harvest yield is excluded.


10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR):

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.


11. Final Provisions

German law shall apply.
If individual provisions of this contract are or become invalid, the remaining provisions shall remain unaffected.
